When should i take action?

Imagine waking up to find your neighbour’s car parked on your drive blocking your vehicle in place – you have suffered a loss (loss of earnings from not turning up to work!) and are therefore entitled to compensation. It would be possible to file a civil claim for your loss however the work involved in doing so would probably make it economically unsound.

Imagine now that the individual chooses to repeat this parking practice every morning; it would be impractical to repeatedly seek compensation through the courts, filing a claim every day, 7 days a week! In such a situation injunctive relief should be sought.

what is injunctive relief?

Injunctive relief or an injunction as it is more commonly known is an order of the courts. To put it in its simplest form, an injunction is a ruling by the court to limit or force a particular action, in this example the injunction would limit the trespassers from parking on your land. If the trespasser breaches the terms of an injunction, they are held in contempt of court and can be fined and imprissoned.
